EXPLANATION:

The County of Blount has six political subdivisions, or local governments:
... One county government:
...... Blount County; and

... Six municipal governments:
...... Alcoa, Friendsville, Louisville, Maryville, Rockford, and Townsend.

The organization of a local government is patterned after federal and state governments, with executive, legislative, and judicial branches. The legislative branch (body) of a local government may be called by such name as "commission" or "council." Federal and state governments properly leave much of the day-to-day operation of services and establishment of local use options to local governments. Local governments are closest to the governed-- the citizens of that political division-- and should be most acquainted with and responsive to the needs of the people.

When a local government needs a law or other legislative action beyond the scope of its authority, that local government may-- and should-- petition its representatives in Nashville or Washington for assistance.

Representatives McCord and/or Overbey and I are the only representatives local Blount County governments have in the Tennessee General Assembly in Nashville (the House of Representatives and the Senate, respectively). It is our responsibility to introduce and defend any resolution sent to us by a local governmental legislative body. We may not necessarily agree with the resolution, but we must represent the request of any local government.

I require that the resolution be submitted in written form, after at least a two-thirds majority vote in a public meeting of the local legislative body.

I post any such request on this Web page to fulfill two features of government, which are very important to me: process (proper application of legislative procedures) and transparency (complete openness to the public in a timely manner of all legislative actions).

VERBATIM TEXT OF LOCAL GOVERNMENT RESOLUTION.
RESOLUTION NO. R07-109

WHEREAS, the concept of the Pellissippi Parkway was developed in the decade of the 1970's to meet the anticipated traffic needs of Alcoa, Maryville, and all of Blount County; and

WHEREAS, the project was approved by the State Legislature in 1987 and construction is either complete or nearing completion on all but the last segment; and

WHEREAS, completion of the final segment is feasible, logical and necessary to meet the overwhelming traffic concerns facing Blount County today.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the City of Alcoa, Tennessee that this body does hereby go on record as supporting the completion of the Pellissippi Parkway to U.S. 321 and that a copy of this resolution be forwarded to the Blount County legislative delegation and the Commissioner of Transportation.

AN ACT to amend Tennessee Code Annotated, Section 57-4-103, relative to placing a referendum question on the ballot concerning the sale of alcoholic beverages for consumption on the premises within the corporate boundaries of certain municipalities.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Section 57-4-103(a)(4), is amended by deleting in its entirety the last sentence, and by substituting instead the following language:

Nothwithstanding the provisions of Section 57-4-106(c) requiring such elections to be held at the next regular election of the municipality, the county election commission shall place the question on the ballot of the November 2008 general election, provided the municipal governing body of the municipality to which the subdivision applies calls for such rerferendum by July 15, 2008; and provided further that all costs associated with such referendum election shall be paid for by the calling municipality.

SECTION 2. The question submitted to the voters shall be in the following form for this election:

For legal sale of wine (TCA 57-3-101(a)(20)) for consumption on the premises in the City of Townsend.

Against legal sale of wine (TCA 57-3-101(a)(20)) for consumption on the premises in the City of Townsend.

SECTION 2 [sic]. This act shall take effect upon becoming a law, the public welfare requiring it.

RESOLUTION NO. 2008-2

A RESOLUTION AMENDING THE CHARTER OF THE CITY OF MARYVILLE, TENNESSEE, AND REQUESTING THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE APPROVE SAID AMENDMENTS

WHEREAS, the City of Maryville, is incorporated by Private Acts 1967, Chapter 27, as amended, of the General Assembly of the State of Tennessee; and

WHEREAS, from time to time said Charter is reviewed by City Council; and

WHEREAS, said review has been accomplished; and

WHEREAS, pursuant to said review, it is in the interest of the City of Maryville, that its charter be therefore amended.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF MARYVILLE, TENNESSEE that:

The Honorable Senator Raymond Finney and the Honorable Representative Doug Overbey, are hereby requested to introduce the following private act to the General Assembly of the State of Tennessee:

An Act to amend the charter of the City of Maryville, Tennessee, being Private Acts 1967, Chapter 27, as amended:

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE REGARDING THE CHARTER OF THE CITY OF MARYVILLE, TENNESSEE:

SECTION 1. Article 11, Section 1, Sub-section 23 be amended by deleting, "or penal institutions."

SECTION 2. Article 11, Section 1, Sub-section 24 be deleted in its entirety.

SECTION 3. Article 11, Section 1, Sub-section 28 be amended by deleting, "Civil Service Systems", and replacing with, "Human Resource Management Systems".

SECTION 4. Article IV, Section 5 be amended by deleting, "7:30", and replacing with "7:00."

SECTION 5. Article IV, Section 7 be amended by deleting, "for permanent disability".

SECTION 6. Article VI, Section 2 be amended by deleting "His" in the last sentence of Section 2.

SECTION 7. Article VII Title be amended by deleting, "Finance," and replacing with, "Financial Services".

SECTION 8. Article VII, Section1 be amended by deleting in all instances the word finance and replacing with "financial services" in all instances.

SECTION 9. Article IX, Section 1 be amended by deleting, "By resolution, Council shall determine the budgetary period of either an annual or biennial budget prior to the beginning of each fiscal year."

SECTION 10. Article IX, Section 2 be amended by deleting, "or biennial".

SECTION 11. Article IX, Section 3, Section 4, and Section 8 be amended by deleting in all instances "year(s)" and replacing with, "year".

SECTION 12. Article IX, Section 11 be deleted in its entirety and replaced with the following new Article IX. Section 11: Section 11 every appropriation shall lapse at the end of the annual budget period to the extent that it has not been expended.

SECTION 13. Article IX, Section 13 shall be amended by deleting "(10%)" and replacing with "(15%)" and further be amended by adding the following after the word area in the first sentence of Section 12, "net of any fund balance available within Debt Service Fund".

SECTION 14. Article IX, Section 15, Sub-section 4 be amended by deleting, "biennial" and replacing with, "Annual".

SECTION 15. Article XI, Section 5 be amended by deleting the last three sentences of Section 5.

SECTION 16. That this act become effective when it has been approved by the City Council by a vote of not less than two-thirds (2/3 rds) of the entire memebrship of the council.

Therefter, the Mayor shall certify to the Tennessee Secretary of State the approval or rejection of the act by the City Council.

Resolution No. 121406

WHEREAS: State Route 33, also known as Old Knoxville Highway, is the main thoroughfare of the City of Rockford, Tennessee; and

WHEREAS: The Tennessee Department of Transportation and a study and planning group associated with the new Research and Development Park adjacent to the City of Rockford, Tennessee are considering the widening of State Route 33; and

WHEREAS: Said group may consider widening State Route 33 through the City of Rockford, Tennessee from its present two lanes to four lanes; and

WHEREAS: The State of Tennessee lacks sufficient right-of-way to widen State Route 33 through the City of Rockford, Tennessee; and

WHEREAS: Widening of State Route 33 would destroy the character and quality of life in the City of Rockford, Tennessee, and would inflict undue hardship on its citizens; and

WHEREAS: The Mayor and City Commission of the City of Rockford, Tennessee are unanimously and admanatly opposed to widening State Route 33 within the city limits of Rockford, Tennessee; and

NOW, THEREFORE, BE IT RESOLVED: The City of Rockford, Tennessee, enlist the cooperation and support of the Tennessee Department of Transportation and all elected officials, to oppose any attempt to widen State Route 33 beyond its existing two lanes through the city limits of Rockford, Tennessee; and

BE IT FURTHER RESOLVED: that the City of Rockford, Tennessee urges all roadway planning around the Research and Devcelopment Park to utilize Pellissippi Parkway, which currently ends at the Research anbd Development Park, and Hunt Road, which is less than one-half mile from the Research and Development Park, to handle the sxpected increases in traffic.
